North DakotaNorth Dakota made an early bid to regulate online poker. In 2005, the state was poised to pass legislation that would have licensed and regulated online poker. But the U.S. Department of Justice sent an unsolicited letter that declared online gaming was in contravention of federal law. The letter – which the DOJ effectively rescinded in 2011 – killed the legislation and any hopes of regulating online poker in North Dakota. The state does allow residents to bet on horses online and purchase lottery subscriptions. The North Dakota Racing Commission licenses and regulates websites that allow players to bet on horse races online. North Dakota offers online lottery subscriptions for its multi-state games. Only residents of North Dakota are able to purchase lottery tickets online. There are no laws pertaining to or legalizing of daily fantasy sports in North Dakota, but the state allows all major DFS companies to conduct business and accept state residents.
