Judge Rules Casino Must be in Buffalo

NEW YORK – As reported by the Buffalo News: "A State Supreme Court justice ruled Wednesday that if a casino is built by the Seneca Nation in Erie County, it must be built in Buffalo.

"In a 51-page decision, Justice Joseph G. Makowski severed a portion of the 2002 compact between the state and the Senecas, permanently enjoined the state from releasing funds for the project and prohibited Uniland Development Corp. of Amherst from selling a 57-acre parcel near the Buffalo Niagara International Airport in Cheektowaga to the Senecas for the casino.

"…Seneca President Rickey L. Armstrong Sr. blasted the ruling and said the nation vows that the city's ploy to strong-arm the Senecas into building in Buffalo will fail.

"…Seneca Nation officials announced in April their intent to locate a third area casino on the Cheektowaga site. The Nation operates the Seneca Niagara Casino in Niagara Falls and a casino on the Allegany Reservation in Salamanca.

"…If a site chosen in Buffalo was unavailable, the memorandum of understanding between the state and Senecas authorizes the Nation to 'propose' an alternate site, the judge said.
