Daily fantasy sports deemed a game of skill in New York

The New York State Court of Appeals came to the conclusion on Tuesday that daily fantasy sports are considered a game of skill rather than a game of chance, making it legal in The Empire State under current law. It was a close 4-3 vote in favor of daily fantasy sports.

The discussion on whether daily fantasy sports should be legal in New York has been doing on for several years. It wasn't until 2016, that the state legalized DFS.

However, in 2016, a lawsuit was brought forth by four New York residents who believed that daily fantasy sports was a form of gambling and it therefore violated the state's constitution. Tuesday's decision puts an end to that debate and confirms that daily fantasy sports are seen as games of skill in New York and are not a form of illegal gambling.

Sports betting in New York is not affected by this decision. Mobile sports betting in the state launched just over two months ago and the numbers that the books are reporting have been historic.
