Co-policymaker of online provider dismissed after proposed Ksa designation

23 Jul 2024

(PRESS RELEASE) -- The Dutch Gaming Authority has informed one of its licensees that it would receive a binding instruction if a newly appointed co-policymaker remained active. This person did not pass the Ksa's reliability test due to involvement in illegal offering in a previous position, and as far as the Ksa is concerned, may therefore not be involved in the provider's policy. The person in question has since been dismissed. It is the first time that the Ksa has imposed such an intention to send an online gambling provider a direction to dismiss.

Licensed gambling providers must inform the Ksa of changes in the board or of other persons who help determine the company's policy. Following such a change, the integrity of a new co-policymaker is assessed. This involves looking at antecedents, such as (previous) positions with companies that offer illegal gambling or other relevant violations or criminal activities.

The Ksa emphasizes that it is the responsibility of the provider to sufficiently investigate the integrity of new directors and co-policymakers. If the Ksa investigation shows that the reliability of a director is not beyond doubt, the Ksa will take enforcement action.
