KahnawakeThe Kahnawake Gaming Commission was created in June 1996 pursuant to provisions in the Kahnawake Gaming Law. The Commission enacted its Regulations Concerning Interactive Gaming in July 1999. The regulations were designed to ensure that interactive gaming activities settle three basic principles: that only suitable persons and entities are permitted to operate, that games are fair to players, and that winners are paid. Mohawk Internet Technologies handles all hosting of interactive gaming services in the Mohawk Territory. The application fee for an interactive gaming license is CAD$25,000, nonrefundable. Applicants must also submit a CAD$15,000 nonrefundable deposit to defray costs of probity checks and systems testing. A CAD$10,000 license fee for the first year of operation must also be submitted alongside the application, but the fee is refundable if a license is not awarded. Interactive gaming licenses are granted for two-year periods, and annual license fees are CAD$10,000. The Gaming Commission may also authorize an interactive gaming license holder to host a client that provides interactive gaming. The application fee for a client provider authorization license is $10,000, nonrefundable. The interactive gaming license holder is responsible for supervising the activities of an authorized client provider and is jointly liable with the authorized client provider for its actions. Applicants must also submit a $15,000 nonrefundable deposit to defray costs of probity and systems testing. A $10,000 license fee for the first year of operation must also be submitted alongside the application, but the fee is refundable if a license is not awarded. Client provider authorization licenses are granted for two-year periods and annual license fees are $10,000. The Gaming Commission also awards secondary client provider authorization licenses, for which either an applicant or an authorized client provider may submit an application. If the applicant submits the application for a secondary client provider authorization, it must be accompanied by a $15,000 fee. If an authorized client provider submits the application it must be accompanied by a $5,000 fee. Authorization is good for two years, and applications are $5,000. Key-person licenses are also required for each individual with a prominent role in the operation of a licensed entity.
